1. Agreement

These Terms of Service (“Terms”) govern your access to and use of visionOS fan at https://visionos.fan, operated by Gohil Tech Empire Pvt. Ltd. (“we”, “us”, “our”).

By creating an account, purchasing a plan, or using visionOS fan, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

If you use visionOS fan on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The service

visionOS fan is a software / digital product provided on a hosted or downloadable basis as described on https://visionos.fan. Features may change over time as we improve the product. We may add, modify, or discontinue features with reasonable notice when practicable.

We do not guarantee uninterrupted or error-free operation, but we will use commercially reasonable efforts to keep the service available.

3. Accounts

You are responsible for:

• Providing accurate account information
• Keeping login credentials confidential
• All activity under your account

Notify us promptly at gohil@visionos.fan if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Acceptable use

You agree not to:

• Use visionOS fan for unlawful, harmful, or fraudulent purposes
• Attempt to gain unauthorized access to systems, data, or other users’ accounts
• Interfere with or disrupt the service, including via malware, scraping abuse, or denial-of-service activity
• Reverse engineer, resell, or redistribute the service except as expressly allowed
• Misrepresent your identity or affiliation
• Violate applicable laws or third-party rights

We may investigate violations and suspend or terminate access as needed.

5. Purchases, billing, and Paddle

Paid plans and digital purchases for visionOS fan are processed by Paddle as Merchant of Record. When you buy through Paddle:

• Your purchase agreement for payment processing is also subject to Paddle’s buyer terms and policies
• Paddle handles checkout, invoicing, taxes, and payment methods
• Subscription renewals (if applicable) continue until cancelled according to the plan and Paddle’s cancellation flow

Prices, currencies, and plan details are shown at checkout or on https://visionos.fan. Taxes may be calculated and collected by Paddle where required.

For billing issues related to card charges, invoices, or tax receipts, contact Paddle support or gohil@visionos.fan and we will help route the request.

6. Subscriptions and cancellations

If you purchase a subscription:

• Access continues for the paid term
• Auto-renewing subscriptions renew for successive periods unless cancelled before the renewal date
• You may cancel future renewals through the billing portal or by contacting gohil@visionos.fan
• Cancellation stops future charges; it does not automatically entitle you to a refund for the current period except as stated in our Refund Policy

7. Intellectual property

visionOS fan, including its software, design, branding, and content we provide, is owned by Gohil Tech Empire Pvt. Ltd. or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for your internal business or personal purposes according to your plan.

You retain ownership of content you upload or create in the product (“Customer Content”). You grant us a limited license to host, process, and display Customer Content solely to operate and improve visionOS fan.

Feedback you provide may be used by us without obligation to you.

8. Third-party services

visionOS fan may integrate with or link to third-party services (including Paddle). Those services are governed by their own terms. We are not responsible for third-party services we do not control.

9. Disclaimer of warranties

To the maximum extent permitted by law, visionOS fan is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Gohil Tech Empire Pvt. Ltd. and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of visionOS fan.

Our total aggregate liability arising out of or related to these Terms or the service will not exceed the amounts you paid to us (via Paddle) for visionOS fan in the twelve (12) months before the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You agree to defend and indemnify Gohil Tech Empire Pvt. Ltd. against claims, damages, and expenses arising from your misuse of visionOS fan, your Customer Content, or your violation of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate access if you breach these Terms, fail to pay fees when due, or if continued access creates risk to the service or other users. You may stop using visionOS fan at any time and request account closure by contacting gohil@visionos.fan.

Provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will survive termination.

13. Changes to the Terms

We may update these Terms from time to time. The effective date at the top will change when we do. Material changes may be communicated by email or in-product notice where appropriate. Continued use after changes take effect constitutes acceptance where permitted by law.

14. Governing law

These Terms are governed by the laws of India and Few other Countries, without regard to conflict-of-law principles. Courts located in India and Few other Countries will have exclusive jurisdiction over disputes, except where mandatory consumer protections require otherwise.
